Legal Frameworks and Quality Standards of Amami Kokuto Shochu
Amami Kokuto Shochu is a protected regional brand shaped by centuries-old traditional methods, outstanding quality, and the unique terroir of the Amami Islands.
To pass this heritage down to future generations, its place of origin and quality standards are strictly guarded by the Japan Patent Office (JPO) Regional Collective Trademark system and special exemptions in the national Liquor Tax Law.
1. Two Major Legal Frameworks Protecting Amami Kokuto Shochu
To bear the name "Amami Kokuto Shochu" and guarantee its authenticity, distilleries must meet strict legal requirements. These protect the brand value from counterfeits and false origin claims.
JPO Regional Collective Trademark
In 2009, "Amami Kokuto Shochu" was registered under the JPO as a Regional Collective Trademark (Registration No. 5202680). [1] This legally prohibits the use of the term on any spirits not made in the Amami Islands, preventing trademark infringement and brand dilution.
Liquor Tax Law Exemption
Under Japan's Liquor Tax Law regulations, distilling spirits using rice koji and brown sugar and classifying it as "Authentic Shochu" is permitted exclusively within the Amami Islands of Kagoshima Prefecture (under the Oshima Tax Office jurisdiction). [2] This historical exception is the legal cornerstone preserving traditional methods.
2. Status of "Geographical Indication (GI)" under the National Tax Agency
The Geographical Indication (GI) system is an intellectual property framework that protects the names of specific agricultural products or alcoholic beverages whose quality, reputation, or other characteristics are essentially attributable to their geographical origin.
⚠️ Note on Geographical Indication (GI) Status
Currently, alcoholic GIs designated by the National Tax Agency (NTA) include "Satsuma" (sweet potato shochu from Kagoshima) and "Ryukyu" (awamori from Okinawa).
As of July 2026, Amami Kokuto Shochu is not designated as a National Tax Agency GI (unregistered). [3]
However, local distilleries and the Shochu Association are actively working to draft quality guidelines and legal definitions to obtain GI status in the future. 3. Grading System for Raw Brown Sugar (Kokuto)
The primary ingredient defining the flavor of Amami Shochu is brown sugar (kokuto). Since kokuto is made by boiling down raw sugarcane juice, its quality varies based on harvest season, soil quality, and processing methods. Therefore, agricultural trade standards employ a strict grading system based on chemical analysis and sensory evaluation.
